○３０年数年前の受験時代に短答式(択一)試験合格のためは、兎に角、条文に関する正確な知識が必要とのことで憲法・民法・刑法の重要条文についてテープに吹き込み繰り返し聴き、特に憲法は前文から補則まで全文を一字一句漏らさず暗記していました。 ○ところが実務に就いたら憲法を開くことが殆ど無くなり、忘却の彼方となっていました。「この憲法は、ＧＨＱ統治下、アメリカ人がたった２週間で仕上げた適当な憲法」であり、「憲法前文は、悪文も甚だしい代物だが、適当に仕上げられた翻訳と思われるので、致し方がない。」なんて評価もありますが、人類の理想を述べていることは間違いなく、記憶力訓練のため英文を含めて暗記に挑もうかと思っております。 前 文 日本国民は 正当に選挙された国会における代表者を通じて行動し われらとわれらの子孫のために 諸国民との協和による成果と わが国全土にわたって自由のもたらす恵沢を確保し 政府の行為によって 再び戦争の惨禍が起ることのないようにすることを決意し ここに主権が国民に存することを宣言し この憲法を確定する。 We, the Japanese people, acting through our duly elected representatives in the National Diet, determined that we shall secure for ourselves and our posterity the fruits of peaceful cooperation with all nations and the blessings of liberty throughout this land, and resolved that never again shall we be visited with the horrors of war through the action of government, do proclaim that sovereign power resides with the people and do firmly establish this Constitution. そもそも国政は 国民の厳粛な信託によるものであって その権威は国民に由来し その権力は国民の代表者がこれを行使し その福利は国民がこれを享受する。 Government is a sacred trust of the people, the authority for which is derived from the people, the powers of which are exercised by the representatives of the people, and the benefits of which are enjoyed by the people. これは 人類普遍の原理であり この憲法は かかる原理に基づくものである。 This is a universal principle of mankind upon which this Constitution is founded. われらは これに反する 一切の憲法、法令および詔勅を排除する。 We reject and revoke all constitutions, laws, ordinances, and rescripts in conflict herewith. 日本国民は恒久の平和を念願し 人間相互の関係を支配する崇高な理想を深く自覚するのであって 平和を愛する諸国民の公正と信義に信頼して われらの安全と生存を保持しようと決意した We, the Japanese people, desire peace for all time and deeply conscious of the high ideals controlling human relationship, and we have determined to preserve our security and existence, trusting in the justice and faith of the peace-loving peoples of the world. われらは 平和を維持し 専制と隷従 圧迫と偏狭を 地上から永遠に除去しようと努めている国際社会において 名誉ある地位を占めたいと思う。 We desire to occupy an honored place in an international society striving for the preservation of peace, and the banishment of tyranny and slavery, oppression and intolerance for all time from the earth. われらは 全世界の国民が ひとしく恐怖と欠乏から免れ 平和のうちに生存する権利を 有することを確認する。 We recognize that all peoples of the world have the right to live in the peace, free from fear and want. われらは いずれの国家も 自国のことのみに専念して 他国を無視してはならないのであって 政治道徳の法則は 普遍的なものであり この法則に従うことは 自国の主権を維持し 他国と対等関係に立とうとする 各国の責務であると信ずる。 We believe that no nation is responsible to itself alone, but that laws of political morality are universal; and that obedience to such laws is incumbent upon all nations who would sustain their own sovereignty and justify their sovereign relationship with other nations. 日本国民は 国家の名誉にかけ 全力をあげて この崇高な理想と目的を 達成することを誓う。 We, the Japanese people, pledge our national honor to accomplish these high ideals and purposes with all our resources. 以上：2,743文字
